Arbitration

Arbitration is increasingly common in construction contracts. It is an alternative to court-based litigation, resolving disputes but with the apparent advantages of privacy (arbitration proceedings are confidential) and flexibility (unlike the court rules, the arbitration process can be easily tailored to suit the parties’ needs). Unlike adjudication, it also leads to a final determination.
